Who qualifies as the family member of an EU citizen?
If you come from a non-EU country, then to count as the family member of an EU citizen, you must be: – in a permanent relationship or partnership with an EU citizen and sharing a common household OR – the spouse of an EU citizen OR – the parent of an EU citizen who’s under the age of 21 OR – a child under the age of 21 whose parent is an EU citizen If your partner is a Czech citizen, then after holding a temporary residence permit for 2 years, you are eligible for permanent residence. If they come from another EU country, you can apply for permanent residence after 5 years. Note: If you and your EU citizen partner live together but aren’t married or civil partners, then you can still apply for temporary residence as the family member of an EU citizen. In this case, the process may be more complicated and take longer (6 – 9 months), and you will be checked at home by the Czech Foreign Police. You should have comprehensive health insurance for foreigners throughout the application process.
